Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the hardinlife,com website (the "Service") operated by Hardin Life Resources® to purchase any services (seminars, counseling, consulting) offered, heninceforth the use of "we", "us," "our" will refer to Hardin Life Resources®®. The term “Service(s) will refer to “seminars”, “continuing education seminars”, "counseling", "consulting", and “usage of the Hardin Life Resources Website to register and pay for seminars, counseling, and consulting”.
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Service.
Purchases
If you wish to purchase/register for services made available through the Service ("Buy it Now/Purchase",PayPal Buttons, Stripe Processing Buttons, GoToWebinar Button Links, Register Here Buttons and or Links to Eternal Sources), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, security code, your billing address, email address, telephone number and your shipping/billing address/information. You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.
The service may employ the use of third party services for the purpose of facilitating payment and the completion of Purchases. Third party services utilized may change over time without notification to parties. By submitting your information on the service website, you grant us the right to provide the information to these third parties. We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons. We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.
Availability, Errors and Inaccuracies
We are constantly updating service offerings on the Service. We may experience delays in updating information on the Service and in our advertising on other web sites, including but not limited to, if a seminar has reached full capacity, sold out, and/or not accepting more registrations, cancelled, change of seminar dates, locations, and/or speakers. The information found on the Service may contain errors or inaccuracies and may not be complete or current. Products or services may be mispriced, described inaccurately, or unavailable on the Service and we cannot guarantee the accuracy or completeness of any information found on the Service. We therefore reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice. We reserve the right to refuse service, remove or edit content, or cancel orders in our sole discretion.
Intellectual Property
The Service and its original content, features and functionality are and will remain the exclusive property of Hardin Life Resources, and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Hardin Life Resources®.
Links To Other Websites
Our Service may contain links to third party web sites or services (for example, PayPal, GoToWebinar, Stripe) that are not owned or controlled by Hardin Life Resources®. Hardin Life Resources®, has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party web sites or services. We do not warrant the offerings of any of these entities/individuals or their websites. You acknowledge and agree that Hardin Life Resources® shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third party web sites or services. We strongly advise you to read the terms and conditions of any third party web sites or services that you visit.
Refunds/Cancellations/Postponements/Payment Options for Workshops
Refunds and/or Cancellations: If a refund is requested by the participant, a partial refund, minus a $25.00 adminstrative fee will be provided regardless of the time period of when the request is received for all seminars in which the registration fee charged was $70 or more. If the seminar was under $70, customers will be given a refund of 50% of what was charged/paid. Additionally, a credit card fee will be assessed to all refunds, to cover the cost of PayPal and/or Stripe processing charges on credit cards (these fees usually range from 2.2% – 2.9% of the total conference cost depending on PayPal and or Stripe's current algorithm utilized at the time of payment). All refund and/or cancellation requests must be in writing, thus emailed to bridget@bpointl.org.
No refunds will be issued if received less than 2 weeks of the event. Please note only clicking the cancellation box on webinar correspondence DOES NOT meet this requirement. A written request must be emailed. If a participant fails to contact us prior to the seminar, as well as fails to appear for the seminar, no refunds will be issued, nor will attendance of another seminar be allowed. Regarding live webinar events, we do not provide refunds due to the following:
(1) Attendee technology problems: It is the responsibility of the webinar attendee to test their computer setup prior to the start of the webinar. If a technical failure at your location (work, home, other locations of your preference) prevents access to the live webinar, you are not eligible for a refund. If the technical problem is due to our error, we will consider issuing a refund.
(2) Attendee email issues: Refunds will not be issued in cases where an attendee did not receive the webinar login instruction email due to issues like restricted emails, bounced emails, or any other system issues. It is the attendee’s responsibility to contact us if they don’t receive the required login information at least 48 hours prior to the start time of the webinar.
(3) No shows: Attendees who do not participate in the live webinar will not be entitled to a refund.
Company Cancellations: If Hardin Life Resources® cancels a seminar, a full refund will be given. Hardin Life Resources® reserves the right to cancel any seminar for any reason deemed appropriate.
Postponements: At times, postponing a seminar may be unavoidable (such as illness of a presenter, family tragedy, etc). If a seminar is postponed, all registered will have the option to attend the seminar on the newly scheduled date, or have their registration transferred to another seminar of their choice within the next 6 months. No refunds will be given. If a seminar is not attended within that 6 month period, attendance of another seminar is forfeited.
Certificates: Certificates are emailed to customers within 10 business days of all seminars held. If a customer loses, misplaces, or otherwise cannot find their certificate that was originally provided which includes incidents of email returns or non-responses due to supplying us with an incorrect email address at the time of registration and attendance of webinars, Hardin Life Resources® will provide an additional certificate electronically with an administrative charge of $30.00. This includes if a customer contacts us to state they did not receive their certificate by email and we can provide documentation that it was sent to the email address provided at the time of registration. ADDITIONAL RESEARCH FEE: While we understand that mishaps occur, unfortunately we have received an increase in customers contacting us, stating they know they attended a seminar, but do not know the date or the title of the seminar. In this instance, they are requesting staff to look through records for large spans of time, often including an entire year or more, to determine their attendance and then send duplicate certificates. This creates additional time for staff, outside of the norm, when a customer does not know the date and/or title of the seminar. Therefore, an additional fee of $20.00 will be charged in cases such as these and will be due BEFORE staff begin this review process. If a customer requests a certificate to be mailed through the United States Postal Service, Hardin Life Resources® will mail the certificate with an administrative charge of $40.00. Refusal of Service: We may bar access to any service immediately, without prior notice or liability, under our sole discretion, without limitation, including but not limited to a breach of the Terms listed on our website. We may bar access to any service if Hardin Life Resources believes that a customer conduct violates applicable law or is harmful to the interests of Hardin Life Resources® and its subsidiaries. A violation that is harmful to the interests of Hardin Life Resources® includes but is not limited to: Video recording of live seminars (regardless of format), taking pictures of the screen during live presentations, copying of seminar materials given during attendance (handouts and other documentation) for distribution in a commercial capacity and/or using in a competitors seminar business without written permission of Hardin Life Resources®.
BY ENROLLING, REGARDLESS OF PAYMENT METHOD, MEANS YOU AGREE TO AND WILL ADHERE TO OUR TERMS AND CONDITIONS LISTED ON THIS WEBSITE.
Accommodation/Modification Seminar Requests
Hardin Life Resources® ADA Course Modification Policy
In accordance with the Americans with Disabilities Act (ADA), Hardin Life Resources® is committed to ensuring that there is no discrimination against individuals with disabilities on the basis of disability in the full and equal enjoyment of Hardin Life Resources® goods, services, facilities, privileges, advantages, or accommodations. In furtherance of this commitment, Hardin Life Resources® will offer seminars in an accessible manner to individuals with disabilities. 42 U.S.C. § 12189; 28 C.F.R. § 36.309. Hardin Life Resources® will make modifications as are necessary to ensure that the place and manner in which the seminar is given are accessible to individuals with disabilities. Hardin Life Resources®will provide appropriate auxiliary aids and services for persons with impaired sensory, manual, or speaking skills, unless we can demonstrate that offering a particular auxiliary aid or service would fundamentally alter the seminar or would result in an undue burden. (Undue burden is defined by ADA as "significant difficulty or expense"). If a specific communications method would be an undue burden, Hardin Life Resources® will provide an effective alternative, if there is one. Hardin Life Resources® will administer seminars that are accessible to individuals with disabilities or make alternative accessible arrangements. Alternative arrangements will provide comparable conditions to those provided for nondisabled individuals, such as, for example, the same opportunity to interact with an instructor, and ask questions. 28 C.F.R. § 36.309(c)(4)-(5).
The ADA Course Modification Coordinator is Karla Hardin LPC-S, NCC, Karla Hardin is authorized to receive and review requests for modifications, auxiliary aids or services and can be reached at bridget@bpointl.org.
Accommodations/Modifications Requests must be received in writing 60 days prior to the seminar date of choice for proper determination and resolution. Requests must be emailed to Bridget, bridget@bpointl.org. Within one week of receiving a request, Hardin Life Resources® through its ADA Course Modification Coordinator, will adhere to the following procedures for considering the request:
(1) Grant the request;
OR
(2) Make a narrowly tailored request for more information about the request and, within three (3) days of receiving the information, grant or deny the request;
OR
(3) Deny the request upon establishing that offering the particular auxiliary aid or service would fundamentally alter the seminar or would result in an undue burden, and/or offer alternative accessible arrangements.
Indemnification
You agree to indemnify and hold harmless Hardin Life Resources®, and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms. Hardin Life Resources® advertises how many hours as well as which type of continuing education hours are given for all seminars, including but not limited, to National Board for Certified Counselors (NBCC). All attendees of seminars are solely responsible for ensuring that their own licensing board will accept the continuing education hours offered by Hardin Life Resources® prior to attendance. No refunds of any kind will be given if requested by an attendee who did not verify with their own licensing board prior to attendance, that the continuing education hours offered would be accepted. Attendance of another seminar due to this issue is also not allowed.
Limitation Of Liability
In no event shall Hardin Life Resources®, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
Hardin Life Resources® makes every effort to produce quality seminars, but there are many ways to treat/interact with different customer populations and that all specific methods offered may not be the best approach for each individual customer. Also, while we do our best to provide quality seminars and are an NBCC approved continuing education provider, we are not liable for continuing education hours not being credited by licensing boards of our customers. It is the customer's responsibility to ensure they attend seminars that will be accepted by their own licensing board. Hardin Life Resources®, its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components.
Exclusions
Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.
Governing Law
These Terms shall be governed and construed in accordance with the laws of Alabama, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material changes, these can be made at any time, for any reason. Additionally, what constitutes a material change will be determined at our sole discretion. Customers will be notified of the changes via header/popup on front and/or landing page with a revision date which may appear as "Terms and conditions Updated (Date). Your continued use of the site/services denotes your agreement to the Terms of Service.
Continuing To Access Or Use Our Service
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
